1. Policy Statement #

Scholars Portal commits to the continued preservation of the information entrusted to its care, even in the event the repository ceases to operate or its governing or funding agency changes in scope.

Since it is impossible to predict exactly what conditions may lead to a situation where the succession plan is necessary, Scholars Portal does not outline a specific scenario. Instead, we have established a set of principles that will be used to determine an appropriate course of action that both ensures the integrity of the platform’s contents and the rights of the Designated Community.

2. Principles of Succession #

The following principles are also outlined in the agreement between OCUL and UTL, as described in the OCUL Service Agreements document.

  • OCUL Institutions shall retain ownership of the materials in the Scholars Portal platform, as determined by the entitlements system at the time the agreement is terminated.
  • OCUL institutions are entitled to be provided a copy of this material if desired. This transfer will be through a process to be negotiated between UTL and the recipient, with costs and timelines to be agreed upon. This material will be in a format agreed to be generally accessible and/or usable by the recipient.
  • UTL will commit to continued preservation of the material in question until all claims of entitlement to material are resolved with the agreement of OCUL.
  • OCUL may request the material be transferred to a third party for the purposes of continued preservation and/or provision of access. This is understood not to conflict with UTL’s right to preserve and make available to its user communities the material to which it is entitled.

Regular
